Our Terms & Conditions and Privacy Policy

This document sets out the terms applicable to customers using SellFone’s device sale and repair services, and explains how SellFone collects, uses, stores, and shares personal data.

 

1. SellFone service overview

Service What it covers

Support Customer support through website chat, email, phone, or any other channel made available by SellFone.

2. Terms and Conditions

1. Acceptance of terms. By visiting, booking, submitting a device, requesting a quotation, or accepting service from SellFone, the customer agrees to these Terms & Conditions.

2. Eligibility and authority. The customer confirms that they are at least 18 years old and are the lawful owner of the device, or otherwise fully authorized to sell, hand over, or service the device.

3. Device verification. SellFone may verify the device using IMEI, serial number, model information, condition checks, functionality tests, account lock status, physical inspection, and ownership-related checks before accepting the device.

4. Quotation and pricing. Any price estimate is provisional until inspection is completed. The final offer may change based on condition, functionality, completeness of accessories, display quality, battery health, water damage, account lock status, and market conditions.

5. Right to decline. SellFone may refuse purchase or service where the device is stolen, suspected to be stolen, reported lost, locked, tampered with, counterfeit, blacklisted, or otherwise unsuitable for sale or repair.

6. Acceptance of sale. For device sale orders, the device becomes SellFone’s property only after final inspection, customer acceptance of the final offer, and completion of payment/receipt confirmation as per SellFone’s process.

7. Payment. Payment may be made by cash, bank transfer, UPI, wallet, or other methods offered by SellFone. Any payment timing displayed to the customer is an estimate and may be affected by verification, banking, or operational delays.

8. Accessories and data. The customer is responsible for removing SIM cards, memory cards, passwords, biometric locks, and personal accessories unless otherwise instructed. SellFone is not responsible for loss of data, accounts, or personal content left on the device, except where required by law.

9. Repair authorization. For repair orders, the customer authorizes SellFone to open the device, run diagnostics, replace parts, update software, test the device, and perform all actions reasonably required to complete the repair.

10. Repair estimates. Repair quotes may change after diagnosis if hidden damage, additional faults, unavailable parts, or prior repairs are discovered.

11. Parts and service quality. SellFone may use new, OEM-compatible, or refurbished parts only where permitted and, where feasible, such use will be disclosed to the customer before installation.

12. No guarantee of complete recovery. Repairs improve the stated fault only. SellFone does not guarantee the restoration of unrelated issues, pre-existing damage, or third-party accessories, accounts, or software problems.

13. Customer responsibility after repair. The customer should inspect the device immediately after return. Issues reported after acceptance may be handled in accordance with the applicable warranty or service policy, if any.

14. Warranty. Any warranty, if offered, applies only to the specific part or service covered and for the period disclosed at the time of service. Warranty does not cover physical damage, liquid damage, unauthorized repairs, software tampering, misuse, or normal wear and tear.

15. Cancellations. Once diagnostics, disassembly, verification, or repair work has started, SellFone may charge a reasonable inspection or service fee even if the customer cancels the order.

16. Uncollected devices. If the customer fails to collect a repaired device or respond within the period communicated by SellFone, the company may charge storage fees and/or treat the device in accordance with its uncollected-device policy and applicable law.

17. Fraud, misuse, and illegal activity. SellFone may suspend, cancel, or report any order involving fraud, abuse, fake identity, blacklisting, threats, or unlawful conduct.

18. Limitation of liability. To the fullest extent permitted by law, SellFone will not be liable for indirect, incidental, special, or consequential losses, including loss of profit, data, or business opportunity, arising from use of the service.

19. Customer indemnity. The customer agrees to indemnify and hold harmless SellFone against claims, losses, or expenses arising from the customer’s breach of these terms, ownership disputes, or unlawful use of the device.

20. Force majeure. SellFone is not responsible for delay or failure caused by events beyond reasonable control, including transport disruptions, supply shortages, power failures, internet outages, strikes, or government action.

21. Changes to service. SellFone may update service workflows, pricing, supported brands, supported models, or service channels at any time.

22. Governing law and jurisdiction. These terms are governed by the laws of India. Subject to applicable consumer law, disputes shall be subject to the courts having jurisdiction in Bangalore, Karnataka.

3. Privacy Policy

23. Information we collect. SellFone may collect name, phone number, email address, address, device details, IMEI/serial number, quotation history, order history, location information, support chats, payment references, and any other information you submit during a sale or repair request.

24. How we use information. We use personal data to process requests, verify devices, provide quotations, complete repairs, make payments, contact customers, provide support, prevent fraud, improve service quality, comply with law, and maintain internal records.

25. Device and technical data. We may record device model, condition, battery health, storage state, lock status, screenshots or photos taken during inspection, and repair notes to document service outcomes and resolve disputes.

26. Communication. We may contact you by phone, SMS, WhatsApp, email, or other channels for quotation updates, pickup/visit coordination, service alerts, payment updates, warranty follow-up, and customer support.

27. Sharing of information. We may share information with employees, technicians, logistics partners, payment processors, customer support providers, IT/service vendors, and legal or regulatory authorities when required to run the business or comply with law.

28. No sale of personal data. SellFone does not sell your personal data in the ordinary sense. Any sharing is limited to service delivery, legal compliance, fraud prevention, analytics, or operational support.

29. Data retention. We keep personal data only for as long as reasonably necessary for service delivery, accounting, warranty handling, dispute resolution, fraud prevention, and legal compliance.

30. Data security. We use reasonable administrative, technical, and physical safeguards to protect personal data. No system is completely secure, and SellFone cannot guarantee absolute security.

31. Customer responsibilities. Before handing over a device, the customer should back up important data, remove SIM and memory cards, sign out of sensitive accounts, and disable security locks when requested for service.

32. Cookies and website analytics. Our website may use cookies or similar technologies to support site functionality, measure performance, remember preferences, and improve the user experience.

33. Children. SellFone services are intended for adults or for minors acting through a parent or legal guardian. We do not knowingly collect personal data from children without appropriate consent.

34. Your rights. Subject to applicable law, you may request access, correction, or deletion of certain personal data, or object to certain processing, by contacting SellFone using the details below.

35. Third-party links. Our website or communications may contain links to third-party services. SellFone is not responsible for their privacy practices or content.

36. Cross-border processing. Where service providers store or process data outside India, SellFone will take reasonable steps to ensure appropriate protection consistent with applicable law.

37. Changes to this policy. SellFone may update this Privacy Policy from time to time. The latest version posted by SellFone will apply from the date of publication.
